The requirements of \u00a7 121.353 were implemented to increase the chance of survival and rescue for airplane occupants in the event of an accident or emergency in areas of uninhabited terrain. The Preamble to the Final Rule that amended \u00a7 121.353 in 1995 (60 FR 65832)<\/span> did not attempt to change requirements for flying over uninhabited terrain, nor did it attempt to clarify or amend the definition of \u201cuninhabited terrain.\u201d The Preamble stated that defining uninhabited terrain is \u201cnot necessary \u2026[s]ince implementation is on a case-by-case basis.\u201d<\/span> Currently, no legal interpretation that speaks to the definition of \u201cuninhabited terrain\u201d exists and none are expected.<\/span><\/p><\/blockquote>\n

In addition, this rulemaking does not define \u2018\u2018uninhabited terrain.\u2019\u2019 When the predecessor regulation to \u00a7 121.353 was proposed in CAB draft release 58\u201324 in 1960, \u2018\u2018uninhabited terrain\u2019\u2019 was defined as \u2018\u2018flights for long distances over frigid or tropical land areas for which the Director finds such equipment to be necessary for search and rescue operations because of the character of the terrain to be flown over.\u2019\u2019<\/span> When the rule was adopted, the wording was changed to provide the Administrator more flexibility in identifying uninhabited areas.
\nSince implementation is on a case-by-case basis through operations specifications<\/span>, it was determined that the proposed wording was not necessary. This provision has been in effect for over 30 years without any problem about the meaning of \u2018\u2018uninhabited areas.\u2019\u2019<\/p><\/blockquote>\n\u5176\u5b9e\u6211\u770b\u4e0d\u592a\u61c21995\uff0860 FR 65832\uff09\u5230\u5e95\u8bf4\u7684\u662f\u4ec0\u4e48\uff0c\u770b\u6837\u5b50\u662f\u5728\u4fee\u8ba2\u89c4\u7ae0\u65f6\u7684\u6d41\u6c34\u8d26\u3002<\/p>\n
\u6240\u4ee5\uff0cFAA\u7684\u89e3\u91ca\u8bf4\u57281960\u5e74\u7684\u65f6\u5019\u6709\u8fc7\u89e3\u91ca\uff0c\u4f46\u662f\u4e3a\u4e86\u66f4\u4fbf\u4e8e\u7ba1\u7406\u8005\u7075\u6d3b\u5730\u4f7f\u7528\u8fd9\u4e00\u6761\uff0c\u89e3\u51b3\u529e\u6cd5\u662f\u5728\u8fd0\u89c4\u4e2dcase-by-case\u7684\u6279\u51c6\u3002<\/p>\n
