For purposes of this part, the definition of \u201caircraft accident\u201d includes\u00a0\u201cunmanned aircraft accident,\u201d as defined herein.<br \/>\n\uff08\u7ffb\u8bd1\uff1a\u822a\u7a7a\u5668\u4e8b\u6545\uff1a\u4e00\u4e2a\u4e8b\u4ef6\u53d1\u751f\u4e8e\uff1a\u67d0\u4eba\u4e0a\u98de\u884c\u5668\u60f3\u8981\u4ece\u4e8b\u98de\u884c\uff0c\u5230\u6b64\u4eba\u4e0b\u98de\u673a\u4e4b\u95f4\uff0c\u8fd0\u884c\u98de\u884c\u5668\u7684\u884c\u4e3a\u6240\u9020\u6210\u7684\u4efb\u4f55\u4eba\u7684\u6b7b\u4ea1\u3001\u53d7\u4f24\u6216\u98de\u884c\u5668\u4e25\u91cd\u635f\u4f24\u3002\u8fd9\u91cc\u6240\u6307\u7684\u98de\u884c\u4e8b\u6545\u5305\u62ec\u65e0\u4eba\u673a\u7684\u4e8b\u6545\uff09<\/p>\n<p>Civil aircraft means any aircraft other than a public aircraft.<\/p>\n<p>Fatal injury means any injury which results in death within 30 days of the accident.<br \/>\n\uff08\u7ffb\u8bd1\uff1a\u81f4\u547d\u4f24\uff1a\u9020\u621030\u5929\u5185\u6b7b\u4ea1\u7684\u53d7\u4f24\uff09<\/p>\n<p>Incident means an occurrence other than an accident, associated with the operation of an aircraft, which affects or could affect the safety of operations.<br \/>\n\uff08\u7ffb\u8bd1\uff1a\u4e8b\u4ef6\uff1a\u9664\u4e86\u4e8b\u6545\u4ee5\u5916\uff0c \u548c\u822a\u7a7a\u5668\u8fd0\u884c\u6709\u8054\u7cfb\u7684\uff0c\u5f71\u54cd\u6216\u53ef\u80fd\u5f71\u54cd\u8fd0\u884c\u5b89\u5168\u7684\u4e8b\u60c5\uff09<\/p>\n<p>Operator means any person who causes or authorizes the operation of an aircraft, such as the owner, lessee\u627f\u79df\u4eba, or bailee\u53d7\u6258\u4eba of an aircraft.<\/p>\n<p>Public aircraft means an aircraft used only for the United States Government, or an aircraft owned and operated (except for commercial purposes) or exclusively\u7279\u610f leased for at least 90 continuous days by a\u00a0government other than the United States Government, including a State, the District of Columbia, a territory or possession of the United States, or a political subdivision of that government. \u201cPublic\u00a0aircraft\u201d does not include a government-owned aircraft transporting property for commercial purposes and does not include a government-owned aircraft transporting passengers other than: transporting (for\u00a0other than commercial purposes) crewmembers or other persons aboard the aircraft whose presence is required to perform, or is associated with the performance of, a governmental function such as firefighting,\u00a0search and rescue, law enforcement, aeronautical research, or biological or geological resource management; or transporting (for other than commercial purposes) persons aboard the aircraft if the aircraft is\u00a0operated by the Armed Forces or an intelligence agency of the United States. Notwithstanding\u5c3d\u7ba1\u5982\u6b64 any limitation relating to use of the aircraft for commercial purposes, an aircraft shall be considered to be a\u00a0public aircraft without regard to whether it is operated by a unit of government on behalf of another unit of government pursuant\u4f9d\u7167 to a cost reimbursement\u8865\u507f agreement, if the unit of government on whose behalf\u00a0the operation is conducted certifies to the Administrator of the Federal Aviation Administration that the operation was necessary to respond to a significant and imminent threat to life or property\u00a0(including natural resources) and that no service by a private operator was reasonably available to meet the threat.\uff08\u56fd\u5bb6\u822a\u7a7a\u5668\uff1a\u7f8e\u9b3c\u4eba\u516c\u79c1\u5206\u660e\uff0c\u6211\u61d2\u5f97\u7ffb\u8bd1\uff09<\/p>\n<p>Serious injury means any injury which: (1) Requires hospitalization\u4f4f\u9662 for more than 48 hours, commencing within 7 days from the date of the injury was received; (2) results in a fracture\u65ad of any bone (except\u00a0simple fractures of fingers, toes, or nose); (3) causes severe hemorrhages, nerve\u795e\u7ecf, muscle, or tendon\u52b2\u5065 damage; (4) involves any internal organ\u5668\u5b98; or (5) involves second- or third-degree burns, or any burns\u00a0affecting more than 5 percent of the body surface.<\/p>\n<p>Substantial damage means damage or failure which adversely\u4e0d\u5229 affects the structural strength, performance, or flight characteristics of the aircraft, and which would normally require major repair or\u00a0replacement of the affected component. Engine failure or damage limited to an engine if only one engine fails or is damaged, bent fairings or cowling, dented skin, small punctured holes in the skin or\u00a0fabric, ground damage to rotor or propeller blades, and damage to landing gear, wheels, tires, flaps, engine accessories, brakes, or wingtips are not considered \u201csubstantial damage\u201d for the purpose of this part.<br \/>\n\uff08\u7ffb\u8bd1\uff1a\u4e25\u91cd\u635f\u574f\uff1a\u5bf9\u7ed3\u6784\u5f3a\u5ea6\u3001\u6027\u80fd\u3001\u98de\u884c\u7279\u6027\u9020\u6210\u4e0d\u5229\u5f71\u54cd\uff0c\u8981\u6c42\u4fee\u7406\u6216\u66ff\u6362\u53d7\u5f71\u54cd\u90e8\u4ef6\u3002\u53d1\u52a8\u673a\u5931\u6548\u6216\u635f\u574f\u6841\u67b6\u3001\u53d1\u52a8\u673a\u7f69\u3001\u51f9\u9677\u3001\u7a7f\u5b54\uff0c\u53d1\u52a8\u673a\u6868\u53f6\u3002\u635f\u4f24\u8d77\u843d\u67b6\u3001\u8f6c\u5411\u8f6e\u3001\u8f6e\u80ce\u3001\u895f\u7ffc\u3001\u53d1\u52a8\u673a\u9644\u4ef6\u3001\u5239\u8f66\u6216\u7ffc\u5c16\u5c0f\u7ffc\u4e0d\u88ab\u8ba4\u4e3a\u662f\u4e25\u91cd\u635f\u574f\uff09<\/p>\n<p>Unmanned aircraft accident means an occurrence associated with the operation of any public or civil unmanned aircraft system that takes place between the time that the system is activated with the purpose of\u00a0flight and the time that the system is deactivated at the conclusion of its mission, in which:<\/p>\n<p>(1) Any person suffers death or serious injury; or<\/p>\n<p>(2) The aircraft has a maximum gross takeoff weight of 300 pounds or greater and sustains substantial damage.<\/p>\n<p>[53 FR 36982, Sept. 23, 1988, as amended at 60 FR 40112, Aug. 7, 1995; 75 FR 51955, Aug. 24, 2010]<\/p>\n<p>Subpart B\u2014Initial Notification of Aircraft Accidents, Incidents, and Overdue Aircraft<\/p>\n<p>top<br \/>\n\u00a7 830.5 Immediate notification.<\/p>\n<p>top<br \/>\nThe operator of any civil aircraft, or any public aircraft not operated by the Armed Forces or an intelligence agency of the United States, or any foreign aircraft shall immediately, and by the most\u00a0expeditious\u8fc5\u901f means available, notify the nearest National Transportation Safety Board (NTSB) office1 when:<\/p>\n<p>1 NTSB regional offices are located in the following cities: Anchorage, Alaska; Atlanta, Georgia; West Chicago, Illinois; Denver, Colorado; Arlington, Texas; Gardena (Los Angeles), California; Miami,\u00a0Florida; Seattle, Washington; and Ashburn, Virginia. In addition, NTSB headquarters is located at 490 L&#8217;Enfant Plaza, SW., Washington, DC 20594. Contact information for these offices is available at\u00a0http:\/\/www.ntsb.gov.<\/p>\n<p>(a) An aircraft accident or any of the following listed serious incidents occur:<\/p>\n<p style=\"padding-left: 30px;\">(1) Flight control system malfunction or failure;\u98de\u884c\u63a7\u5236\u7cfb\u7edf\u6545\u969c<\/p>\n<p style=\"padding-left: 30px;\">(2) Inability of any required flight crewmember to perform normal flight duties as a result of injury or illness;\u98de\u884c\u4eba\u5458\u53d7\u4f24\u751f\u75c5<\/p>\n<p style=\"padding-left: 30px;\">(3) Failure of any internal turbine engine component that results in the escape of debris\u788e\u7247 other than out the exhaust path;\u53d1\u52a8\u673a\u6392\u51fa\u788e\u7247<\/p>\n<p style=\"padding-left: 30px;\">(4) In-flight fire;\u7740\u706b<\/p>\n<p style=\"padding-left: 30px;\">(5) Aircraft collision in flight;\u78b0\u649e<\/p>\n<p style=\"padding-left: 30px;\">(6) Damage to property, other than the aircraft, estimated to exceed $25,000 for repair (including materials and labor) or fair market value in the event of total loss, whichever is less.\u9020\u6210\u9664\u822a\u7a7a\u5668\u5916\uff0c25000USD\u7ef4\u4fee\u8d39\u7528\u6216\u5e02\u573a\u4ef7\u683c<\/p>\n<p style=\"padding-left: 30px;\">(7) For large multiengine aircraft (more than 12,500 pounds maximum certificated takeoff weight):\u5bf9\u4e8e12500LB\u4ee5\u4e0a\u7684\u6700\u5927\u8d77\u98de\u91cd\u91cf\u7684\u5927\u578b\u591a\u53d1\u98de\u673a\u6709\u4ee5\u4e0b\u8981\u6c42\uff1a<\/p>\n<p style=\"padding-left: 60px;\">(i) In-flight failure of electrical systems which requires the sustained use of an emergency bus powered by a back-up source such as a battery, auxiliary power unit, or air-driven generator to retain flight\u00a0control or essential instruments;\u98de\u884c\u65f6\u7535\u6c14\u7cfb\u7edf\u6545\u969c\uff0c\u9020\u6210\u5fc5\u987b\u7528\u5907\u7528\u7535\u6e90\u6765\u7ef4\u6301\u98de\u884c\u548c\u5fc5\u8981\u8bbe\u5907\u3002<\/p>\n<p style=\"padding-left: 60px;\">(ii) In-flight failure of hydraulic systems that results in sustained reliance on the sole remaining hydraulic or mechanical system for movement of flight control surfaces;\u98de\u884c\u65f6\u6db2\u538b\u7cfb\u7edf\u6545\u969c\uff0c\u9700\u8981\u6301\u4e45\u4f9d\u8d56\u552f\u4e00\u7684\u6db2\u538b\u7cfb\u7edf\u6216\u673a\u68b0\u7cfb\u7edf\u6765\u63a7\u5236\u98de\u884c\u64cd\u7eb5\u9762\u3002<\/p>\n<p style=\"padding-left: 60px;\">(iii) Sustained loss of the power or thrust produced by two or more engines; and\u6301\u4e45\u635f\u59312\u4e2a\u4ee5\u4e0a\u53d1\u52a8\u673a\u63a8\u529b\u3002<\/p>\n<p style=\"padding-left: 60px;\">(iv) An evacuation of an aircraft in which an emergency egress system is utilized.\u4f7f\u7528\u5e94\u6025\u51fa\u53e3\u8fdb\u884c\u7d27\u6025\u64a4\u79bb\u3002<\/p>\n<p style=\"padding-left: 30px;\">(8) Release of all or a portion of a propeller blade from an aircraft, excluding release caused solely by ground contact;\u635f\u5931\u6868\u53f6<\/p>\n<p style=\"padding-left: 30px;\">(9) A complete loss of information, excluding flickering, from more than 50 percent of an aircraft&#8217;s cockpit displays known as:\u9664\u4e86\u8bbe\u5907\u95ea\u70c1\u5916\uff0c\u635f\u593150%\u4ee5\u4e0a\u9a7e\u9a76\u8231\u663e\u793a\uff1a<\/p>\n<p style=\"padding-left: 60px;\">(i) Electronic Flight Instrument System (EFIS) displays;<\/p>\n<p style=\"padding-left: 60px;\">(ii) Engine Indication and Crew Alerting System (EICAS) displays;<\/p>\n<p style=\"padding-left: 60px;\">(iii) Electronic Centralized Aircraft Monitor (ECAM) displays; or<\/p>\n<p style=\"padding-left: 60px;\">(iv) Other displays of this type, which generally include a primary flight display (PFD), primary navigation display (PND), and other integrated displays;<\/p>\n<p style=\"padding-left: 30px;\">(10) Airborne Collision and Avoidance System (ACAS) resolution advisories issued either:ACAS\u53d1\u51fa\u54a8\u8be2\u4fe1\u606f<\/p>\n<p style=\"padding-left: 60px;\">(i) When an aircraft is being operated on an instrument flight rules flight plan and compliance with the advisory is necessary to avert\u8eb2\u907f a substantial risk of collision between two or more aircraft; or<\/p>\n<p style=\"padding-left: 60px;\">(ii) To an aircraft operating in class A airspace.<\/p>\n<p style=\"padding-left: 30px;\">(11) Damage to helicopter tail or main rotor blades, including ground damage, that requires major repair or replacement of the blade(s);<\/p>\n<p style=\"padding-left: 30px;\">(12) Any event in which an operator, when operating an airplane as an air carrier at a public-use airport on land:<\/p>\n<p style=\"padding-left: 60px;\">(i) Lands or departs on a taxiway, incorrect runway, or other area not designed as a runway; or<\/p>\n<p style=\"padding-left: 60px;\">(ii) Experiences a runway incursion\u4fb5\u72af that requires the operator or the crew of another aircraft or vehicle to take immediate corrective action to avoid a collision.<\/p>\n<p>(b) An aircraft is overdue and is believed to have been involved in an accident.\u98de\u884c\u5668\u903e\u671f\u672a\u5230\u3001\u5e76\u88ab\u8ba4\u4e3a\u548c\u67d0\u4e8b\u6545\u6709\u5173\u3002<\/p>\n<p>[53 FR 36982, Sept. 23, 1988, as amended at 60 FR 40113, Aug. 7, 1995; 75 FR 927, Jan. 7, 2010; 75 FR 35330, June 22, 2010]<\/p>\n<p>\u00a7 830.6 Information to be given in notification.<\/p>\n<p>top<br \/>\nThe notification required in \u00a7830.5 shall contain the following information, if available:<\/p>\n<p style=\"padding-left: 30px;\">(a) Type, nationality, and registration marks of the aircraft;<\/p>\n<p style=\"padding-left: 30px;\">(b) Name of owner, and operator of the aircraft;<\/p>\n<p style=\"padding-left: 30px;\">(c) Name of the pilot-in-command;<\/p>\n<p style=\"padding-left: 30px;\">(d) Date and time of the accident;<\/p>\n<p style=\"padding-left: 30px;\">(e) Last point of departure and point of intended landing of the aircraft;<\/p>\n<p style=\"padding-left: 30px;\">(f) Position of the aircraft with reference to some easily defined geographical point;<\/p>\n<p style=\"padding-left: 30px;\">(g) Number of persons aboard, number killed, and number seriously injured;<\/p>\n<p style=\"padding-left: 30px;\">(h) Nature of the accident, the weather and the extent of damage to the aircraft, so far as is known; and<\/p>\n<p style=\"padding-left: 30px;\">(i) A description of any explosives, radioactive materials, or other dangerous articles carried.<\/p>\n<p>Subpart C\u2014Preservation of Aircraft Wreckage, Mail, Cargo, and Records<\/p>\n<p>top<br \/>\n\u00a7 830.10 Preservation of aircraft wreckage, mail, cargo, and records.<\/p>\n<p>top<br \/>\n(a) The operator of an aircraft involved in an accident or incident for which notification must be given is responsible for preserving to the extent possible any aircraft wreckage, cargo, and mail aboard the\u00a0aircraft, and all records, including all recording mediums of flight, maintenance, and voice recorders, pertaining\u5173\u4e8e to the operation and maintenance of the aircraft and to the airmen until the Board takes\u00a0custody\u5b88\u62a4 thereof or a release is granted\u7406\u6240\u5f53\u7136\u7684 pursuant\u4f9d\u636e to \u00a7831.12(b) of this chapter.<\/p>\n<p>(b) Prior to the time the Board or its authorized representative takes custody of aircraft wreckage, mail, or cargo, such wreckage, mail, or cargo may not be disturbed or moved except to the extent\u00a0necessary:<\/p>\n<p style=\"padding-left: 30px;\">(1) To remove persons injured or trapped;<\/p>\n<p style=\"padding-left: 30px;\">(2) To protect the wreckage from further damage; or<\/p>\n<p style=\"padding-left: 30px;\">(3) To protect the public from injury.<\/p>\n<p>(c) Where it is necessary to move aircraft wreckage, mail or cargo, sketches, descriptive notes, and photographs shall be made, if possible, of the original positions and condition of the wreckage and any\u00a0significant impact marks.<\/p>\n<p>(d) The operator of an aircraft involved in an accident or incident shall retain all records, reports, internal documents, and memoranda\u5907\u5fd8\u5f55 dealing with the accident or incident, until authorized by the Board\u00a0to the contrary.<\/p>\n<p>Subpart D\u2014Reporting of Aircraft Accidents, Incidents, and Overdue Aircraft<\/p>\n<p>top<br \/>\n\u00a7 830.15 Reports and statements to be filed.<\/p>\n<p>top<br \/>\n(a) Reports. The operator of a civil, public (as specified in \u00a7830.5), or foreign aircraft shall file a report on Board Form 6120.1\/2(OMB No. 3147\u20130001)2 within 10 days after an accident\uff0810\u65e5\u5185\u62a5\u544a\u4e8b\u6545\uff09, or after 7 days\u00a0if an overdue aircraft is still missing\uff08\u903e\u671f\u672a\u5230\u7684\u98de\u673a7\u5929\u540e\u62a5\u544a\u5931\u8e2a\uff09. A report on an incident for which immediate notification is required by \u00a7830.5(a) shall be filed only as requested by an authorized representative of the Board. 2 Forms are available from the Board field offices (see footnote 1), from Board headquarters in Washington, DC, and from the Federal Aviation Administration Flight Standards District Offices.<\/p>\n<p>(b) Crewmember statement. Each crewmember, if physically able at the time the report is submitted, shall attach a statement setting forth the facts, conditions, and circumstances relating to the accident or incident as they appear to him. If the crewmember is incapacitated, he shall submit the statement as soon as he is physically able.<\/p>\n<p>(c) Where to file the reports.
